Terms & Conditions of Rental

By renting equipment from SE Equipment Inc. (“Company”), you (“Renter”) agree to the following Terms and Conditions. Please read these carefully, as they outline important responsibilities and liabilities.

1. Rental Period

The rental period begins when the equipment leaves SE Equipment Inc.'s premises and ends when it is returned in the same condition, excluding normal wear and tear. Any late returns may incur additional charges.

2. Condition of Equipment

Renter acknowledges receiving the equipment in good working condition, free of defects. The Renter is responsible for inspecting the equipment prior to use and must notify SE Equipment Inc. immediately of any visible damage or malfunction. Failure to report any issues within 24 hours of receipt implies acceptance of the equipment as is.

3. Proper Use of Equipment

Renter agrees to use the equipment only for its intended purpose and in accordance with the manufacturer's guidelines and all applicable laws and regulations. The equipment must not be used in any illegal or unsafe manner.

4. Qualified Operators

Only licensed and properly trained individuals may operate the rented equipment. SE Equipment Inc. is not responsible for any damages, injuries, or losses that occur if the equipment is operated by someone who is not properly licensed, trained, or qualified. Any such use of the equipment will void SE Equipment Inc.’s liability and may subject the Renter to additional penalties or charges.

5. Maintenance and Care

Renter is responsible for routine maintenance and care of the equipment during the rental period, including but not limited to checking and maintaining proper fluid levels, greasing, and other required maintenance to keep the equipment in good working order. Renter must return the equipment in the same condition as when it was received, excluding normal wear and tear. Damage due to improper use, lack of maintenance, or operator error will be the responsibility of the Renter.

6. Liability for Damage

Renter assumes full responsibility for the equipment from the time it is rented until it is returned. Renter is responsible for any loss, theft, or damage to the equipment during the rental period. SE Equipment Inc. may charge the Renter for the repair or replacement of damaged or lost equipment, up to the full replacement cost.

7. Insurance Requirements

Renter is required to maintain adequate insurance coverage to protect against damage, loss, or liability arising from the use or operation of the rented equipment. Proof of insurance may be required before equipment is rented.

8. Indemnification

Renter agrees to indemnify and hold SE Equipment Inc. harmless from any claims, liabilities, losses, or damages (including legal fees) arising from the use, operation, or transportation of the rented equipment. This includes any incidents caused by unlicensed or untrained operators, improper use, or failure to follow safety guidelines.

9. Return of Equipment

Renter agrees to return the equipment to SE Equipment Inc. in the same condition as when it was received, excluding normal wear and tear. If the equipment is damaged, missing parts, or in need of repair due to Renter's negligence, SE Equipment Inc. reserves the right to charge for repairs or replacement.

10. Termination of Rental Agreement

SE Equipment Inc. reserves the right to terminate the rental agreement at any time if the Renter fails to comply with these terms and conditions or misuses the equipment. The equipment must be returned immediately upon termination of the agreement.

11. Disclaimer of Liability

SE Equipment Inc. is not liable for any damages, injuries, or losses that occur as a result of improper or unauthorized use of the equipment, including operation by an unlicensed or untrained individual. The Renter assumes full responsibility for ensuring that only qualified personnel operate the equipment and agrees to hold SE Equipment Inc. harmless in such instances.

12. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the state where SE Equipment Inc. is located. Any legal disputes shall be handled within the jurisdiction of said state.

By renting equipment from SE Equipment Inc., the Renter acknowledges and agrees to these Terms and Conditions in full.
